Jury orders NBC to pay Mount Snow $2.1M

As I recall, the Dew Tour had a multi year agreement with Mount Snow. Basically 2 years guarenteed with an option for a 3rd. Year 2 was going to be 2010, which was the Vancouver Olympic year. Because of oppressive VT environmental regulations, Mount Snow COULDN'T cut down some trees and/or grade some land around where the 1/2 pipe is to accommodate a 22 foot superpipe (Mount Snow's pipe is an 18 footer and is limited by the size of the space they have to work with).

The Dew Tour, realizing soon before the Olympics that basically no big name pipe riders would come to a comp on an 18 foot pipe, and potentially disrupt their Olympic 22 foot pipe training, used a clause they thought let them break the contract they had with Mount Snow and then they moved to Killington, who could (and via a challenging snowmaking season barely did) provide a 22 foot pipe. The effort that Killington put into making the snow for the Dew Tour compromised their snowmaking on other Bear Mtn area trails which pissed off the K regulars!!

The judge ruled that the Dew Tour did indeed violate the contract with Mount Snow, as Mount Snow believed they did. And today's ruling agrees with that.

In short, the Dew Tour screwed up with Mount Snow AND also created some extra bad blood during the Chris Nyberg era at Killington - loose, loose

Where is the 2m jury verdict from? The article only mentions that the judge denied both sides motions for summary judgment and trial to be scheduled.

2.2M would be a nice down payment on a HSQ at Attitash.........just sayin' ;)

Are you implying as a replacement for the summit triple? That would be useful although I got the impression that management didn't want to replace that lift, maybe they are concerned about the summit not being able to handle that much traffic?

Yes, I'm referring to the Summit Triple.

From my understanding, the concern is ROI on the lift. Peaks doesn't believe it would attract enough new business to cover the debt.

I hope the money stays at Mt Snow! That could be 70 more tower fan guns! Or more aggressive early season snowmaking. Or a new HSQ for Sunbrook!

I'm sure it will be appealed and probably drag on for a bit longer.

I'm thinking the money will be used to pay down some BlueBird debt. That was one expensive lift.

And the local Southern VT economy lost millions of dollars in patron consumer spending. You reap what you (irrationally) sow.
