well, that article points towards september, not the recent deluge of rain we have had in october. also, northern VT has had a lot of rain lately, but no where near what's happening in central and lower new england. september was not that bad for rain either, so they can't blame the weather. actually, anything short of a complete flood they should be held accountable for. they really should have plans in place. as it is, this isn't jay's first violation of water codes as cited in the article:

In a February Environmental Court order, Jay Peak acknowledged its failure to install a required stormwater control system for a group of townhouses. The stormwater system was 15 months overdue.

The company also acknowledged building a second set of townhouses without a stormwater permit and installing stormwater prevention measures that didn't meet state standards.
normally i am not a fan of the big resort pattern, but more power to jay peak for building a golf course. however, they need to do it in accordance with the regulations that every other resort company in vermont is held accountable to. i say jay needs to do what they are told and VT took appropriate action since jay was negligent in their building and violated their permits.

further, that article points towards multiple and repeated violations. this doesn't seem like a one time accident.
