A successful New York ballet dancer is run down on an intermediate slope by a beginner skier who is not watching where he is going. She suffers an anterior cruciate ligament rupture, ruining her career. Can you recover damages for the ballerina?

Good thoughts, uphill. You present fair and rational ideas on the subject. It is definitely a tough issue to come down on. Certainly the viability of patroling skiers/riders as we would like is nearly impossible.
There has been at least one case where an out of control skier has been prosecuted for hitting another skier--I believe it was a drunk skier at Vail who ran into and killed a kid taking ski lessons.
