Warm Dec.=MC lawsuit

The worst season in 20 years will live on in a lawsuit filed by Mountaincreek against its insurer under a policy designed to guard against interruption of business resulting from warm weather during the period leading up to the usually lucrative Christmas holidays. MC claims the insurance company is calculating average temperatures in a manner that skews them downwards, and that the temp readings actually taken on the mountain demonstrate the average temp exceeded 33 degrees, as required for a pay out. The policy limit is $1.7 million.

A friend of mine owns all of the lockers down at MC and told me about this back over X-mas break. It just is way to shady that the day they decided to open just happened to be the day that the insurance maxed out.
I would have been incredibly pissed if I payed for a season pass at a resort who did not open to collect on a policy.

Another story came out today, with the following comment posted afterwards: Meanwhile, Mountain Creek sells season tix for 260.00 until December 6th or the first snowfall over 2 inches". So because of a freak snowstorm on Oct 31st, I and many others had to pay 360.00 for the tix even though they didn't open until December 26th.

Another post: If the Creek wins will they use the $ to give a partial refund to the season ticket holders, who are the ones that got scr*wed here.

If I understand the main article correctly, MC is not happy with the choice it originally made in the contract to go with a company from several states away to calculate the temps, which company utilized federal government data from points near, but not on, the mountain.

Each time I read the woes of the Creek I thank god that long ago I decided the extra 15 minute drive to the Pocono's is so worth it. Camelback may not be the Rockies but they certainly seem to have their s#@t much more together then MC. Hidden had such a rough season that some of their racers were coming out to train at CBK. That little bit of elevation and further west location really pays off.

Yes but from midweek skiing their was always nice, now that i'm 30 minutes to MC i sure i try some nights there.

Hidden Valley only managed to get two trails open from top to bottom (not including the beginner trail) all season. They had to concentrate their snowmaking on just resurfacing the two trails for racing all season on the few nights they got snowmaking temps.
