Not the first time that has happened, and probably isn't the last time.

Was she not carrying an ID on her?? I would think that would clear up all confusion immediately

Happy Veteran's Day Llam.

From what I understand, they didn't know the name of the true culprit. She just fit her description and, of course, got picked out in the lineup.

Was she denied to call her guardian? I am sure her guardian could have cleared things up immediately with a little paperwork, I can't believe she was in jail for a week though.

I'm guessing her guardian couldn't do anything to help. She fit the description, she was picked out of a lineup. It was either cough up the bail or stay in jail. I don't think she was denied her rights, the only caveat was that she was charged as an adult.

I'm not doing a good job of making myself clear here. They didn't know the name of the real suspect, they just had a description. She fit the description and was picked out in a photo (or traditional) lineup. It's a classic case of mistaken identity.

I understand 100% what you are saying. I understand she matched the description. I am saying that I would think they would have let her go if her guardian showed paperwork showing that her name was different than that of the suspects. Or maybe I am confused.....Did they not have the name of the suspect at the time when they picked her up? Then everything would make sense.....

Honest mistake, but If I was that girl and her family I would be in the 1st class car of the lawyer train to suing everybodyville. From the cops, to the store owner and corporation, right to the man that fingered her (and god would I take him to the garnished pay check station). I would make sure my week in jail paid for my college at the school of my choice, and then lived off the remainng sums' interest.
