Selectmen Meet in Executive Session About Sugarloaf Ownership

CARRABASSETT VALLEY – A meeting held Wednesday morning to discuss the possible purchase of Sugarloaf Mountain surprised and upset some residents and selectmen.

Several residents expressed concern over the timing and legality of the executive session, which was announced barely 24 hours before being held.

The session was held to allow selectmen to meet with Warren Cook, a former chief operating officer for American Skiing Company, who may be interested in bidding on the Sugarloaf Mountain Corporation. That corporation owns and operates the Sugarloaf/USA, a major factor in the economic development of Carrabassett Valley.

Selectman George Abbott joined members of the community in questioning the legality of meeting in executive session with such short notice. Abbott noted that he himself had received notification of the session just 22 hours before the 9:05 a.m. meeting. Also, Abbott was curious of the timing of the session, which was held just one day before the selectmen met at their regularly scheduled meeting, on May 10.

Town Manager Dave Cota assured Abbott and other residents that he had consulted with the Municipal Association Attorney Richard Flewelling before calling the meeting. Flewelling indicated that the board does indeed have the authority to meet in executive session about the ownership of Sugarloaf under Title 1 M. R. S. A. Section 405 (6) (c).

Abbott did insist that his questions and the manager's answers be recorded before the board entered executive session. He also alerted local newspapers, in case they were unaware of the meeting due to the short notice.

"I did have some questions about the legality of the meeting," Abbott said, "But the town's legal department was pretty clear."

As no decision was reached by the board, the town is not required to release the contents of that session, which ended after an hour of discussion at 10 a.m. The selectmen meet again Thursday at 5 p.m. An explanation for today's executive session, and the timing of the session, is not currently on the agenda. However, any resident present can request that the selectmen explain the legality or necessity of the meeting, if the board chooses to address that resident's concerns.

After leaving the employ of the American Skiing Company, Cook was the president of JAX Research Systems, a division of the Jackson Laboratory, from 1999 to 2003.

owner, American Skiing Co., Carrabassett Valley selectmen met this week
with a potential bidder of the resort.

On Friday, Town Manager David Cota said a 45-minute executive session
was held with Warren Cook of Freeman Township and Carrabassett Valley
Wednesday morning to discuss economic development opportunities.

Cook is a former officer with American Skiing Co. and a former president
of Sugarloaf Corporation. American Skiing is selling off some of its
properties, including Sugarloaf and Sunday River in Bethel.

Warren could not be reached for comment Friday.

Cota said the closed door session was held in compliance with all state
statute notification requirements.

"There are several people bidding on Sugarloaf and we would entertain
meetings with any of them. We will work with anybody who is successful
in buying Sugarloaf," he said.

in a way i kind of hope SL and SR are bought by different people so the sign can go back up on SL

When this whole drama started, I was hoping that both mountains wold be bought by the same company and come as a package. At this point, however, I'm really indifferent as to how they go for as long as they are run well, sell reasonably priced passes and tickets and, most importantly, don't end up on NELSAP. I know that Les Otten has his supporters and enemies but, as jerryg pointed out on one of our lift rides, Otten seems to be the logical choice for Sunday River.

If the pass prices come out in July, so be it. I just hope that the prices are reasonably priced and are not an attempt to gouge loyal customers because, at that point, there are no cheap pass alternatives and skiers have no choice but to pay through the nose.

I would have thought they would have this buttoned down by now. People are still saying that LL Bean will somehow be invovled with Otten at SR. LL Bean for a couple of seasons produced all the ASC resort clothing so they have a history of working together.

Otten also still has a small real estate stake near Bush and he is currently going thru the permit process for a small developement on the Sugarbush Access Rd. I wonder if he still owns property at some of the other former/current ASC resorts?

I miss that sign too! Regardless it might be fun to print up a bunch and post them up in the woods all over Sugarloaf at the right altitude. :-D

Today's Boston Globe ran an article stating the obvious about Les Otten's interest in SR with his departure as an ASC director, as well as his selling his Red Sox shares. It seems he may have several million $$$ burning a hole in his pocket. However, it appears to be speculation at this point…

According to a friend of mine who's actively involved in this, LL Bean is not a part of Team Otten.

Assuming LBO wins, you'll see things move very quickly.

He's got his own snowmaking machine, what do you expect?

I think there could be will be an annoucement between the next half hour and Tuesday by 5:00pm.

Whats the concensus here of Otten owning Sunday River/Sugarloaf?

Personally, I think, and hope, that he learned the mistakes of trying to grow to fast and would be a good fit for owning them again.

LL Bean WAS involved with ASC....but it was limited to producing outerwear for ASC employees.

I wonder if he still owns property at some of the other former/current ASC resorts?

He owns a lot of land in the Sunday River area. The Phoenix is his place (aptly named).
