Perhaps there is some way that they could pull that off if you're really pissy with them, but it just doesn't happen. The max penalty is $1000, and there is no legislation that supports your theory. Not saying it couldn't happen, but I have studied Colorado ski law and tramway law fairly extensively. For the most part, it's a major slap on the wrist, and often a pulled ticket. Sometimes it's worse. Jail... only if you do something else to deserve it. Usually, you don't even get tagged with the fine.
That said, I honestly would never advocate ducking ropes. I have spent enough time around the industry to know that ropes are up for a reason. I have great respect for patrol and mountain management. There is usually plenty of skiing, both in-bounds and back/sidecountry that ducking ropes is just not the right answer.
But you're not going to jail for it.
