I decided to start a new thread so as NOT to tie in all the angst with the good news/solution.

After about a 30 minute ... let's call it airing of issues... "Eastern Boarder" in Worcester and I came to an agreement. I see their side in that they are totally confident that they don't/never will have loc-tite on premises. So it quickly came to a "he said/she said" discussion. SInce my son was unhurt (thankfully) and all he lost was a few hours due to the broken binding (because Killington "gave" him a Burton Royalle to demo for free...we decided that a deep discount on a replacement board was fair to all parties.

They made no profit...in fact they claim to have lost a bit on the replacement board. We opted for the Rome Flag in a 163. We are ready to give a ride this weekend...originally intended to go to Wildcat, but I'm opting to use the great weather to get my wife out onto the snow so we get the whole FAM out there...and eventually ALL go to the Cat.

Anyway, thanks for reading all my rants..and giving all your support. EB eventually did the right thing. We spent a lot of time on the phone and I feel we both made the best of the bad situation.

The boy made out in that I originally only upgraded his bindings. Now his set-up has been substantially upgraded. He's worth it. Great kid doing very well @ Northeastern. Looking forward to seeing him smile on his new ride.

So would I recommend EB to others. Yes. Supporting local small businesses is a good thing. And I would NOT have wanted to attempt resolving this issue with say...The-House or any of the other on-line stores.

*end story*

Maybe we do it a little differently down here, but I would have sued the pants off of them just for asking me for a dime. Were not talking small claims, were talking liability and endangerment issues in civil court. From the past stories, this dude was jerking your around.

The plastic was melted, apperently there is no doubt about that and the fact it was caused by loc-tite in that shop. I don't use loc-tite either, nor is my forum name NYDREW. He can say what he wants, but the evidence was obvious.

I don't live in the area, but if i did I still wouldnt use them because they gave you such grief. I would go back and forcefully put that board up the same place i would put my foot.

looks like you took the high road, Sky. I can't say I would have been so gracious. I'm glad it worked out so well.

NYD and BNYC...you guys represent what seems to be the gambit of responses.

Drew, if there was injury associated with this...there would have been no stopping me. We just went through a dog bite issue (neighbor's dog bit this same son about 10 years ago). It has taken us ages to resolve and we had all the cards. I just didn't see the point in pursuing this in court given the circumstances.

I saw my options and opted to get what I could...in this case an upgrade for my son at a reduced price. I had an option to shop elsewhere, not get as good a deal as I ended with...and not have access to this particular shop that (other than this instance) has always provided good service, guidance, pricing and proximity.

BNYC...High Road for sure. I'm a Karma fan. I also expected to get nothing but heart burn over a continuation of hostilities. Now I feel good (out of ignorance/delusion or God's good graces) and the family is back on snow.

Again...thanks for the support guys.

LIke I said, because he asked me for a dime. Lawsuits aren't worth it, but this guy is a dirtbag who needs a judge to put him in his place.

He actually had the nerve. Just for s and giggles I would take him to small claims for what you paid for the new board. When you make your threat real, most business men will settle outside to avoid bad publicity, this isnt a dog bite case where the owner has nothing to loose by fighting you, this guy can loose his customers.

Trust me...those words were said. I went on a quiet rant about the original "deal" offered.

He handled it very well...and I'd prefer (since we worked it out) not to put the entire dialogue up here.

It was a bad set of circumstances and it just wasn't going to get resolved any better without a huge amount of effort, time, retainer for a mediocre board and damaged bindings and partial lift ticket expense.

Like I said...I was glad my son wasn't hurt. I was happy that Killington spotted him that Burton Royalle...he really loved the higher end board. He's happy with the newer higher end board we bought to replace his original board (replaced because we doubted the integrity of the foam core after seeing the damaged mounting plate)...and we got it deeply discounted.

I'm happy with the way it worked out. Obviously there are other approaches and other preferences for resolution.

I agree, Sky. There is certainly a "breakeven point" when you account for time spent negotiating, price, aggravation and "doing the right thing"; aka "Sky's karma". (Both business owner AND customer!!!) Negotiating through a problem is a lot like skiing; it requires patience and balance.

I'm really surprised that was EB. Been going there since they opened and know a lot of those guys.

"Surprise" is a good word for it. I played the "I've been coming here for about ten years" card.

I was plenty hot...but soon realized it was not going to resolve well...like I said..."He said/She said" argument.

My son used the new board this weekend and is highly impressed. He swapped for a run or two with his brother (Burton Floater and nice Burton Carbon bindings).

The Rome bindings are a quantum leap. The toe strap wraps over the front of the tow and pulls it rear-ward vs the older Burton binding that crosses over the top of the foot. Both sons were impressed with the Rome board with the Rome binding.

Sky, I was thinking about this after reading a post of yours before and decided to dig this one up. (Look out Bvibert, there's a new search hound in town ;) ) How did the rest of the season go for you, your son and this shop? Any awkwardness?
