I'd say "I'm speechless" but you guys have known me for a few weeks and know that I've never really been speechless.

This kind of thing makes me crazy. The sad thing is that, the twit will likely prevail and the poor schmuck who went above and beyond to make this kid happy will get burned. To top it off, the kid will learn a valuable lesson from Dad. Nice Guys Finish Last!

Let's all write to MCAD in support of Wachusett in this ridiculous, frivolous lawsuit.

The morons are the attorneys who put these thoughts into peoples head. I can't even stand to watch midday or late night TV with the ambulance-chasers taking all the ad time. "you have rights", "protect your rights," "we will defend you at no cost to you" and other crap. The attorneys are working a system. That's why they call it a "legal system" and not a "justice system". The attorneys are the only winners in all of this, with sometimes as much as 75% of the award going to the ambulance-chasing scum. It's a bad bad system, which causes everyone from ski schools to doctors to manage defensively rather than trying to keep the client's best interest at hand. With all the attorneys in charge of reform legislation, this one is a non-starter. The effectiveness liability waiver on the back of your lift ticket is conversely proportional to the capabilities of the lawyer. I'd be happy to escort a few of them through the glades someday. Oops, I made a wrong turn.... :flame:

Stupid lawsuit. Sucks for Wachusett, but they can defend themselves. The kid is the one who is really losing out here because his dad is an A**HOLE.

Agreed -- this one is a REAL Stretch > Hopefully cooler and smarter heads prevail and the suit gets tossed >

We ski it several times when visiting family there------ Wa Wa is a well run facility and SS staff there that i have witnessed with my grandkids do an EXCELLANT job .

Not sure where providing individualized instruction at no additional cost violates any part of the Fair Educational Practices chapter.

Is the ski school even an accredited educational institution? Is ADD an issue of race, creed, sex, or national origin? I'm pretty sure asshattedness exists without regard to race, creed, sex, or national origin.

Ridiculous is right! Personally, I prefer one-on-one lessons and the kid was getting them at a discount! Sounds like he wouldn't have been safe otherwise, and isn't safety their number one concern? People will sue over anything these days. What a waste of money and resources...

YIKES. I wonder if I could sue Northwest Airlines cause they discriminated against me and bumped me to 1st class? The sad thing is that it will likely cost less for Wachusett to settle out of court than to fight this to the end. My niece and her husband owned a climbing gym. One night some kids broke in. One of the kids got hurt climbing on the equipment. Parents sued. My neice's insurance decided it was going to be cheaper to settle out of court.

Totally asinine. Utter ridiculous.

Reminds me of a friend of mine years ago who had his house broken into. In the process of breaking into my friend's house, the robber (wandering around in the dark) slipped and fell down the cellar stairs. Ended up breaking his back, in a wheelchair for the rest of his life.

From his PRISON CELL he filed a lawsuit against my friend, and WON!

The asshole is sitting in prison while my friend has to work two jobs just to pay the court-ordered monthly payments to this guy who, as far as I know, is still in prison collecting the checks (he was implicated in a whole string of burglaries so got a LONG sentence).

The legal system in this country is just run amok.

Even special needs kids get "pulled out" occasionally for smaller class settings (tests, instruction, other help).

Hmmmm...I bought a booklet of group lessons @ Wa. THe "problem"is...no one above level 3 takes group lessons...so I get Private lessons at a huge discount (that booklet is bargain and lasts two years).

Maybe I should call my attorney? I want Wa to provide other skiers so I can get my "group" lesson!!

This case might do for ski schools what Sunday Vs. Stratton and THe Kane Case did for the Ski Patrol. What will they call the "Ski School" if they don't want any association with "education"?

I think dad's the one who needs to be "mainstreamed", prefereably while wearing some very heavy footwear. What a dope.

The only ones coming out ahead on this bit of nonsense are the Lawyers.

This article is sickening. Things like this only ends up costing all of us in the long run. Win or lose the resort is going to have to cough up bucks to fight this. I am all for a loser pays court system. Maybe that would help with all of the disgusting and frivolous lawsuits. This gets me so mad I want to tell that pig of a father what a worthless piece of shyt he is.

What the Crowley family should do(Wachusett's owners) is get all the media attention possible on this one. With the very good reputation they have, and the steps they took to accomodate this child, it will make the dad look like an even bigger a-hole than he already does, and a very good chance that the suit will go away

To be clear, at this point it's not a lawsuit. MCAD has issued a "Probable Cause" ruling, which means they're going to take a look at it. Next step is a meeting between the Complainant (Asshat) and the Respondent (Wachussett), to see if there is a mutually agreeable resolution. That resolution may be as simple as Wa saying "Sorry you felt offended or whatever" and that's it, or the Asshat may get all peeved and want to push it. MCAD can then determine yes or no on the discrimination issue. If they say "no", that ends it, since MCAD has jurisdiction. if they say "yes" (and I hope to hell they don't), then it goes to the court system.

Asshat can either have an attorney of his own (which will cost him money) or use an MCAD attorney to prosecute, which will cost the state money, but may end this faster.

Seen this type of stuff in CT. Where special people's parents have good lawyers that are willing to do this for nothing, based on the settlement.
Next time they will sue McDonalds for lack of a good happy meal.
