Also the son of the owner is named Matt which is leading to even more confusion from customersAdditionally, a simple google search would have shown there was an existing business at Killington that uses that name, he made the stupid business decision to use it anyway. If I owned the ski shop, I would be pissed too - as there are people coming into his shop saying they did not receive products they paid for and there is all kinds of bad press going around about this guy.
Bingo...Legality is one thing…ethics is another. No one can convince me he didn’t see the name Skiology on the Killington access road and steal it.
Also all of the “useful information” he puts out is readily available online if you have the slightest inclination do some due diligence and educate yourself. Hes not a meteorologist he is a plagiarist…
I believe it means it was dismissed and can’t be retried.Today's update: https://www.pacermonitor.com/public/case/47604315/Skiology,_LLC_v_Bramble
Wtf does "STIPULATION of Dismissal With Prejudice by Skiology, LLC" mean?
If he is using info/maps from Tropical Tidbits or any other weather sercvice on a paid weather service without permission he is liable. There is not much to decide in such a case, other than damages awarded.dude is charging people and stole their name. in fact everything he spouts off is stolen down to the images from Tropical Tid Bits...
Could I open a strip club named McDonalds?Wasn't charging anyone at the time of the court case and folks competing in different markets can use the same name. It seems the court decided that a Facebook Weather group and a Ski Shop were not competing in the same market, regardless of Matt also selling merch.
Now by all means the Ski Shop could bring another suit to close down his paid access site. That would be a different case than the one dismissed with prejudice. Up to them if that is the best way to invest money in their business.
Call your proposed strip club "Northeast Skiology" instead.Could I open a strip club named McDonalds?
Would be curious to read the actual settlement if someone on here has a pacer subscription
As said, the parties have agreed to drop the lawsuit. They are asking the Court to basically treat the dismissal as on the merits and that it cannot be revived.Today's update: https://www.pacermonitor.com/public/case/47604315/Skiology,_LLC_v_Bramble

There is a chance it would pass legal muster, but for super famous brands there can be a higher hurdle to overcome for other markets particularly ones that are scandalous.Could I open a strip club named McDonalds?
You obviously don't know the backstory.A few years back everyone got very upset with backcountry.com for suing other brands with the name backcountry in it, but yet, in this instance, everyone seems to be on the side of Skiology the ski shop doing the exact same thing and suing some other guy in a different market.
I really don't get it. The weather guy is a blowhard online but those are a dime a dozen, present company included (let me emphasize that point for a moment...). I don't get the hullabaloo other than some thinly veiled jealousy that this guy figured out how to monetize what we all have been doing for years on this forum and others for free.
