I remember discussing this topic on this forum at the time it happened. The opinion at the time was they didn't have standing for a lawsuit due to it being a worker's comp issue. Will be interesting to see if this goes anywhere or ends up being thrown out. There's some really interesting claims and information in the lawsuit...

he $26 piece of equipment — a canvas lanyard — that investigators determined caused the crash, despite the manufacturer’s recommendation that those lanyards be replaced every year.

A $26 piece of kit that was 4 years old & should be replaced every year caused the death!!!!

My only questions are why did it take so long to bring the lawsuit, and why in God's name isnt Vail Resorts settling out of court?

Perhaps one of our lawyers could speculate on this, but my (poor) understanding of law would think it's nuts for Vail to let this go to the end?

It’s the American way to blame everyone. I understand Vail being responsible since they did not follow guidlines on when to replace the lanyard. To blame everyone else is just BS. People need to start to take responsibility for their own actions……

I mean he was an employee who died while working for the mountain. I don’t think its his responsibility and I’m sure his widow is grieving and hoping to at the very least be compensated for something that seemed completely avoidable if Vail had new equipment.

Yea...I agree with the first 3 sentences in hovercraft's post, but not the last one. I also don't believe worker's comp "exclusivity" laws should entirely protect a company if they're outright negligent. An accident is one thing, but failing to follow manufacturer safety recommendations is another. If the claims about the resort actively encouraging employees to see how fast they can go is true as well (including exceeding recommended design speeds), then that also should not let them off the hook for a wrongful death suit just because it occurred on the job. Although not sure how easy that 2nd part would be to prove that they actively encouraged that behavior. Having been on that zipline, the speeds mentioned in the lawsuit claims seem insane to me. Going that fast on that zipline would be terrifying.

My last line wasn’t directed towards this particular individual it was more of a general statement of our culture. Something happens and we create a lawsuit against everyone or identity that is connected to the incident. Kind of a shotgun approach.

I agree…someone slips on ice and wants to sue, burns their mouth on hot soup and wants to sue, doesn’t like the way someone spoke to them…lawsuit
Definitely a lack of accountability and litigious attitude nowadays

Seeing 14 black & double black trails open on today's report, versus the typical 2 (centerline & upper ND) = a great start to the year. Shopping VRBO today to lock in my trips.

Liftline is open even with areas thar are down to bare ground...
Never seen that before. .
Snowing pretty hard when we left..should be quite buried by tomorrow.
